ESA Mystery? was created by calimero
Hi guys,
well to cut a long story short on 15 mar I won ESA conversion appeal on the papers.
I was then transferred back from JSA to ESA wrag. But today i recd letters from DWP saying that the law forbids my claim and that its been closed on 20 mar and my p45 is attached.
I also recd notice of arrears paid from nov till 20mar.
I called the call centre and was advised that No reason was noted on their computer about why the claim was closed though they speculated that they may have closed it just to calculate arrears owed to me. Their computer used abreviation TP....which we think means transitional protection??
As they have promised that they will call back tomorrow to explain this closed claim decision etc do you have any advise on what to expect?

My immediate thought was to ask if you were subject to the 365 day limit for ESA(CB), however, as transfers did not start until April 2011, there is no way that this is the case, unless you were in one of the trial areas, even if that was the case, payements would still be payable until 30/04.

So I am afraid I am at a loss as to what this could be, especially as arrears were paid until 20/03/12.

Hopefully, they will contact you tomorrow and shed some light on the situation. You might want to think about getting face to face advice as these matters are not usually simple to resolve, see

Where to get advice?

If you feel up to it, let us know aht is going on.

Hi C,

Just to add, Transitional Protection means that a claimant will receive the same amount after being transferred from IS/SDA/IB to ESA, as they did before, see :

What will I be paid?

thanks gordon, as i said its a mystery. hopefully they will definitely call tomorrow and have a reasonable explanation. I was hoping you knew of an obscure law they could have used? though its probably a generic template letter.
originally IB to CONT based ESA to IR ESA to ESA (cont or Ir who knows?) its just that I worked for DHSS during last benefit change from Invakidity to Incapacity benefit and i dont remember having to close a claim entirely just to calculate arrears owing. IMHO IB to ESA is proving problematic to DWP and the centralised processing system cut off from direct public access is a sick joke!

Hi guys. Problem solved ! It seems that my claim had been closed automatically by an unattended computer. lol
Apparantly the computer closed the claim in order to re apportion TP (Top Up) Contribution based to my Income related ESA claim., and the system is not quite designed to do this on a live claim. The decision to calculate and repay arrears triggered this.
The upshot is that my claim has been speedily rebuilt and is live again. :)

I am very glad that the mystery has been solved and you case is live again :) On the other hand, I find it rather alarming that this kind of thing can happen with such ease!
