esa national insurance was created by Gainsey
:( has any one come across this problem lost my appeal for esa so i applied under a new condition and got esa awarded was told it would be back dated to 11feb then a couple of days later i got a letter saying im not getting esa because i havent paid enough national insurance so i rang esa and was told if i closed the gap in my national insurance i would get paid so rang tax office they checked and told me my national insurance was up to date does any one know what i can do to get round this im not getting anything my wife works

You need to check again with the DWP for an explanation of exactly what you are missing, and then HMRC to make sure they are both talking about the same NI records.

To qualify for ESA((CB), you need to have sufficient NI Contributions to meet the first Condition and sufficient NI Contributions and/or NI Credits to meet the Second Condition.

In addition, the NI records must have be in the relevant qualifying years to be recognised, so it is possible to have sufficient NI records, but in the wrong years.

The Conditions are explained in detail in paras 41021 onwards in the following.

I found para 41023 of interest

"Entitlement to ESA(Cont) depends on the contribution conditions being satisfied. In practice the NI contribution record is usually obtained and any decision is based on the assumption that the record is factually correct. However, where there is a dispute about the record, the matter must be referred by the DM to HMRC for a formal decision."
