Here we go again! was created by juliette
Hi everyone

Just recieved my second 'limited capability for work questionnaire'...Recieved one last year, recieved a date for a medical and at the final hour, was toldI didn't have to attend!
I don't want to be complacent, but it stressed me out so much before, all the waiting and worrying.I was put into the wrag group which I have attended twice, the third one was a telephone interview, which makes me wonder, why didn't they put me onto the support?

Should I really worry this time? The letter states, that 'I may have to attend a medical'.. :woohoo: lol

Anyone else thinking the same?

Thanks in advance and all the best

Hi J,

I think it is pretty standard to state that you may have to attend a medical.

I'm not sure what your question is. :)

However, if your last ESA WCA, (ESA50) was before March 2011, please be aware that the descriptors and qualifying criteria were changed in March 2011.

You may wish to use the Pdf version of the ESA50 this time, see :

Using The PDF Version Of The ESA50 Questionnaire

How long do I have to complete the ESA50?

ESA50 too big for the envelope

Whilst referring to our ESA claims guides, accessible from here :

ESA Guides

With respect to being in the WRAG (CB), are you aware of this? :

12 Month Limit for ESA(CB) Updated 10/03/12

12 Month Limit for ESA(CB) – Implementation New

Cheers

Hi GG,

The letter that you speak of is to inform all claimants in receipt of Contributary ESA in the WRAG that their benefit will stop after 365 days of receipt.

This comes into force on 30th April 2012, and is applied retrospectively, in other words any time spent in the WRAG (CB) before April 30th 2012 will count against the 365 day entitlement.

See :

12 Month Limit for ESA(CB) Updated 10/03/12

12 Month Limit for ESA(CB) – Implementation New

If you are appealing this most recent WRAG award, you will first receive an automatic reconsideration by a different DM.

If you are placed into the SG at this stage, your ESA payments will continue, and if the decision is after 30/04/12, will be backdated to the date of the revised decision.

If you are not placed in the SG, your ESA will cease from April 30th, and your appeal will be sent forward to the Appeals Tribunal Service.

Again, if at the appeal you are placed in the SG, the SG award will be backdated to the time of the original WRAG decision, your ESA will be reinstated, and your entitlement to ESA will continue for as long as you remain in the SG.
