Specific query re ESA Appeal was created by Wrenko
First of all thanks to all the people behind this site. Subscribed and downloaded all ESA material - so helpful. My wife suffers from acute RSI/Depression. Just had ESA letter saying placed in WRAG. I’m drafting up her appeal to move to Support Group. If I may I have 3 questions.
1) The ATOS GP she saw 2 months ago was exactly the same one she saw back in 2005 for her successful DLA claim. Then he was obviously supportive of her condition as her claim was successful. Now 7 years on her condition has got worse but now after seemingly the same examination he’s saying she’s fit for work in a short number of months. Is it worth mentioning the contradictory nature of his decision making and fact he saw her 7 years ago?
2) Searched on forum without success but if somebody with RSI was successful in their appeal (moving to Support Group) any advice welcome. As you will know the hidden nature of the condition, resulting depression and fact that the impact of repetitive actions is seemingly ignored in the assessment make this a real challenge.
3) Lastly she was successfully assessed for Industrial Injury Benefit (work caused her injury). Assume we should mention this in the appeal?

I don't think you can make much of the apparent discrepancy between the DLA medical 7 years ago and the recent ESA assessment. The criteria for these benefits are very different, especially given last year's change in the ESA descriptors.

There is no harm in including the industrial injuries report, especially if it contains anything that refers to the specific support group criteria.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
