esa failed was created by doormat
took my daughter to medical this lasted approx 20 mns the lady said she had not got her questionaire so she just asked a few questions which i was there and thought the answers was ok one question was what date is it and she got both the date and month wrong
on recieving the dicision it contridicted every thing that happened things like she can go out and talk to people because although she got a lift she entered the building on her own and was able to answer the questions
i personally waked into the building with her and went to the desk while she signed in then sat with her also went into the medical with her
i have wrote a letter for the appeal should i sign it as well as though it is me that wrote it because she doesnt understand it she is 38 and they say she is capable to do things they gave her 6 points for not being able to go to unknown places on her own
thanks pete

I suggest you take professional advice from a Welfare Rights Solicitor and furthermore consult your daughters GP/Social worker/Mental Health Co-ordinator and get a joined up aproach to this matter. Apply for the apeal firstly but please get these factors in place as from your account of the medical and its subsequent descision there are serious health/legal errors and malpractise.

Doormat

If you believe there are factual errors in the medical report you can make a complaint to ATOS Healthcare. See

Complaining to ATOS Healthcare

This process can take a long time, so you should continue with your appeal process. If you are not familiar with what you need to do the following FAQs explain it.

How long do I have to appeal?

How to submit an appeal

Whilst it is important to challenge a medical report especially if you believe there are significant errors, you will not win your daughters claim, either at Reconsideration or Appeal, if you do not show that she meets the ESA descriptors and should score at least 15 points for the WRAG or meets one or more of the Support Group criteria, so you must concentrate on this area.

Have a look at our ESA Appeal guide, which explains the process and what your options are, see

thanks for the help i have got her to appeal and i am sending a letter myself and we have asked for a copy of the face to face medical to see what that says
my advice to anyone is to ask for a recorded copy of the medical by the time i found out about it it was too late
thanks again pete
