On re reading the first section LIB is referring to filling out her ESA50 form and getting in a bit of a tiz waz with it. This needs the help in filling it out rather than worrying about a ATOS medical, which is further down the line.
LIB mentions being to far away from a CAB/Welfare assistance officer and this is where a home visit is really required to assist filling out the forms correctly with the correct additional paperwork and this is where the legal obligation is to assist under welfare rights to support a person who is unable to deal with situations beyond control.

The thing is if I sent the form off requesting a home visit without a supporting gp letter they may send my gp the ESA85 which asks can the patient attend an assessment in a taxi. My GP may put yes but with medication, because as I have mentioned before she has offered me medication to attend
hospital appointments which I cannot take because of the side effects and if she puts yes on that form I'll be in more of a mess because shes not likely to want to retract the statement, so really I have to sort it now

Thanks, I will call them in a minute because I'll just keep worrying about it otherwise.
When you say write a letter to ATOS do I have to give the GP the address to send it themselves or should she do the letter to Atos and give it to me to send with my form? I would prefer to send it with my form as I can photocopy it and I'll know its gone.
Should I give them the address on my pre-addressed envelope they sent with my ESA50 form?

I have heard that gps charge about £40-£45 for letters do you think its reasonable for my GP to charge me for a letter such as this?

When you say you always need a Letter from GP for a home assessment would this include the ESA85 that the GP fills in as they ask 'could this patient attend an assessment in a taxi?' As if she doesnt want to write a letter I could specifically ask her to consider my agoraphobia and other things and why I know I cant go to the assessment centre. Would this also be acceptable to Atos?

This post might have got missed because it popped up late in between others, if anyone can advise on this I'd be grateful.
I won't phone the surgery yet until I find out the above, Thanks everyone

You should either send the letter with your ESA50 or wait until you are contacted regarding a medical, so you can send it to the ATOS Healthcare Centre that will be assessing you. In either case ensure your name and National Insurance Number is clearly written at the top of each page.

The return address for the ESA50 is usually a maildrop serving several ATOS HC's and there is no guarantee that a letter sent to this will get to where it needs to.

Your GP is entitled to charge for these letters, but I would not expect the price to be so high, if indeed they charge at all, see

Charging for medical records

I think the form you are referring to is an ESA113, not an ESA85. This may not be issued by the DWP, and even if it is, this may not be until after your medical, so you cannot rely on this confirming your need for a home medical.

Thanks Gordon and everyone else for your help
What I mean by the ESA113 is that if I don't get a GP support letter to send with my form, Atos may send my GP the ESA113 before they contact me about a medical and she might have already stated on that I could go in a taxi with medication. If she does I wont get a home visit and a support letter at that stage would be too late.

If I could be sure that Atos would contact me about the medical first before my GP I would wait because that way I would only be contacting my GP if it was really neccessary.
I would prefer not to have to contact my GP at all really but I might have no choice.
Do Atos normally ring to arrange medicals before sending an ESA113 to GP?

I checked the return envelope for the ESA50 and it is different to the place where I believe clients go for medicals in my area. I don't trust the system and I can bet sending a support letter to the assessment centre wont go without problems

The problem is that there is no definite point in the process where an ESA113 might be sent to your GP, more importantly, it is entirely possible that an ESA113 will not even be sent, as there is no requirement for the DWP to do so.

Rather than relying on the ESA113, it would be far better for you to source a letter from your GP.
