ESA Interview (Asperger's and Oxygen Therapy)

I have just been called for interview for an IB to ESA interview. I filled the ESA50 out in early April and they have got back to me quicker than I expected.

Sorry to return to a somewhat old topic, but I was in hospital at the end of March.

I have done some reading round and found that the 2005 DLA regulations preclude the calling for interview of anyone (amongst other things) with Asperger's syndrome, or on oxygen.

Link: www.whywaitforever.com/dwpatoscontract.html (search for Asperger)

Do these provisions still apply?

In any case will the building authority want me on the premises with a small oxygen cylinder? My oxygen nurse advises me to use oxygen whenever I an not (a) sitting down and resting, or (b) lying down _awake_ and resting.

Should I take my ESA50 (and supporting materials) with me and is it too much to hope for that the examiner will have read the form, additional pages and supporting information?

Finally, how does one best exercise one's right to have any interview recorded without unduly upsetting the examiner?

Thanks,

Vorondil

There are no specific exceptions to the ESA medical, so having been called for a medical you must attend.

That said, you may be able to have the medical held at your home. You will need to have your GP confirm in writing that you cannot attend in person at an ATOS HealthCare Centre. I have to tell you that ATOS are not obliged to provide a Home medical, so you will need to push for this.

Yes, you can take your ESA50. The ATOS "doctor" is required to read your ESA50 and any attached evidence, although this does not always happen. If this is the case, be sure to note this, as it may be of use at a later date.

With regard to recording the medical, you need to make a request in writing as quickly as possible, doing so may delay the medical being held, and will likely use up one of your two available "medicals".

Good luck

You may find with Health and Safety being of such a high perogative of the govt bodies, taking an oxygen cylinder in with you may pose a problem. Moreover you may be able to use this to your advantage.!!!!
