Atos Medical at home

I was on lowest rate for care to help prepare a meal but I have Ehlers Danlos Syndrome which is really bad these days am pretty much housebound.

It is a fluctuating condition although it is also degenarative and I also have POTS which is causing probs with tabhycardia and am also waiting for brain scan and genetic testing to check if me and my daughter have Vascular EDS.

Had a medical beginning of this month at home and its resulted in me even losing the award I had. I have the medical form and its a joke, the doctor did write everything in about my health problems but when it came to the tickboxes he has found me as having full limb function in all of my limbs which is total nonsense I can barely walk or do anything on a daily basis I am really ill tbh I think I am on my way out

I put in a complaint to Atos about the medical and have also forwarded tehes complains to my local MP, the ombudsman serviceand Independant Case Examiner and anybody else I could find who might help.

My head is buzzing with it all and I am close to breaking point. I dont know if what Im doing is a waste of time anymore. Can anybody please advise me what to do. Can I push for these to be looked at quicker?

I also this morning got a tax statement, more like a printout on half a sheet of paper and nothing else in the envelope from DWP so now I am worried they are going to stop my ESA too.

I dont want to post the complaints here as they are too long unless it might help. Can anybody help before I kick the bucket through stress alone

I have heard back from Atos and they have recieved my complaint and are apparently in the process of investigating it andthe other places mostly have also got back to me to let me know that they have recieved it, e-mail from my local MP office to say that they are writing to DWP/Atos on my behalf.

Well done for highlighting your problems to as manay people as you can think of! It sounds as if your complaints are going through the process.

I believe that DWP are supposed to send out a tax statement to all claimants at the end of April (which is the end of the tax year). I can't say whether your ESA is due to end as I don't know how long you have been getting it or whether you are on contributary or income-related ESA.

Good luck with it all, hopefully with all the people you have contacted some good news may well come about. Have you contacted your welfare officer/cab representative?

Yes you are right about the ESA tax thing a few people had it so its probably ok.

I honestly feel like crying with all this stuff. I also have to deal with my daughters DLA claim she was also refused anything even with the professor at our clinics report!? Its ridiculous?

I dont know if I should ask for reconsideratin for her or just go to appeal straigght away?

The med Dr reminds me of this statement...
'I invent and administer tests to classify disabled people according to what I think are their impairments. Then I carry out experiments to try and make them more like me. If I fail I stop their DLA'

If you appeal a reconsideration is carried out by another decision maker anyway, your case is only forwarded to tribunal if the recon does not go in your favour. Reconsiderations are taking around 3 months at the moment, asking for one first and then appealing would prpably drag the procedings out even longer. For these reasons we usually suggest going straight to appeal rather than asking for a recon.
