oops , should also have added that there is nothing in the recording that I wouldn't be happy for the tribunal to hear

I hope that you will understand that my posts are made to prevent you placing yourself at a disadvantage at your tribunal.

Were you required to sign a waiver by the DWP in receipt of the recording, if so, you need to understand the implications of whatever it is you agreed to, before using the recording.

My last paragraph still stands.

In other words, do not play the recording to other people or publish it on the internet. If you make a recording and you wish subsequently to use it as part of a complaint to the DWP or as part of the appeals process, then send the relevant office a transcript of the pertinent part of the tape. If someone, a tribunal chair for example, then asks for a copy of the recording then it is fine to send it them, but in no other circumstances should you play it or pass it on to other people. You should certainly not do so simply to embarrass or attack the DWP, if you wish to be certain that your actions are lawful.

Hi Tilly,

As the medical was recorded by Atos at your request, then you can submit a copy to be considered by the Tribunal. Tribunals have wide powers on which evidence to accept and which to reject.

You should send a copy of the tape along with any other evidence you are submitting
before the date of your Tribunal and not just leave it to the day of the hearing.

You may also be interested that Professor Harrington recommended piloting the audio recording of face-to-face assessments. The Department commissioned Atos to run a small pilot which was undertaken in the spring 2011. The findings are in the following report (published on 25 April 2012).
