I am due to be migrated from IB to ESA at any time and have got myself worried to the point of irrational thinking.
I know my fears are irrational, but if I knew the facts, then it would lift a lot of stress because I would no longer have these irrational fears.
I have two questions that I am worried about, and will explain my situation below.

I currently get IB and DLA middle rate care (don't qualify for mobility)

I have an occupational pension of approx £460 a month, and I own my own home.
I don't qualify for mortgage interest relief as I do not qualify for income support.

My worries are these

1) If found fit for work I am worried, that I will only end up with my pension and DLA as income, and I will not be able to pay my mortgage.
Please can someone confirm that this fear, although strong, is only paranoia, and I will not lose my home as a result of being found fit for work.

2) I feel that I should go in the support group because I think that I fit the criteria for exceptional circumstances.
I am embarrassed to admit this, but my reason is that I have lots of uncontrolled fits of rage, and am a safety risk to myself.
I also feel that the work related activity in the WRAG would be too much for me, and I may get benefits sanctioned because I am too unwell to attend.
My GP has agreed to write a letter to submit with my ESA50 form, but the mental health services discharged me last year.
They said I chose not to engage with treatment, when in fact, I could not, because I was not well enough to go out some days due to my mental state.
I am on medication Antidepressants and anti-psychotics prescribed off label for anxiety, and my GP increased the dose in March.
My fear is that because I am not supported by the Mental health services, then the DWP won't suport me.

Although I do have pre-existing anxiety and depression, since I realised I was addicted to prescription tranquilisers in 2009, I have been slowly reducing my dose with my GP and am experiencing worsened anxiety and depression as a physical cause of the withdrawal, because these drugs have done physical damage to my nerves.
How do I go about explaining this on the ESA50 form when they have separated physical and mental, which bit of the form do I put my problems on? Physical, mental, or both.

I can go to the CAB for help in completing my form, but they refuse to answer questions such as the ones I have asked on here.
Please can someone confirm that these fears are irrational, and can you give me the rational information please.

Many thanks

I hope you'll understand but I cannot comment on your specific, personal circumstances, merely clarrify the situation as any claimant would find it.

Whilst it is possible that you will be transferred in the near future it is also possible that this will not actually happen. After a year of the transfer process, it is quite clear that a significant number of claimants are being transferred, irrelevant of their re-assessment date. So my best advice, is to be prepared, but not dwell on this happening until it does.

If a claimant fails the transfer and is found Fit for Work, then they can appeal this Decision and whilst waiting for a hearing you would receive the ESA Assessment rate. If you go onto to win your appeal, then you would receive back payments for any missed payments.

Not receiving treatment for your mental health issues, is not in itself reason for you to fail the Exceptional Circumstances criteria, perhaps you could have a word with your GP to see what support they can provide you with.

Hi Gordon

Thanks for your reply.
Sorry to be awkward but there are a few things I don't understand.

I don't understand it when you said the transfer may not happen, I thought every IB claimant was being migrated to ESA.

I know you cannot answer questions about my specific circumstances, but I don't feel as if I posted anything too specific.

I just want to know what the rules are with regards to being found fit for work and how it will affect my income, as I have been having irrational fears about my income dropping dramatically, when in reality it may not. It would save all of this additional stress which I could do without.

The appeals process may be more than I can handle, so I am aiming for ATOS to find me unfit for work by my strong application.

Thank you for telling me that not receiving treatment for mental health issues, is not in itself reason for me to fail the Exceptional Circumstances criteria.

I don't know what else I could say to my GP as she has already agreed to write a letter to submit with my form.

Thank you for also telling me that if a claimant fails the transfer and is found Fit for Work, then they receive the ESA Assessment rate.

Thanks for also telling me I will recive ESA at the assessment rate, if my claim goes to appeal. I am trying not to think of appeals, as I really don't think I have enough strength left to go through more agonizing while going through the appeals process, because I self injure then too stresed and don't want to be more of a risk. (seeing GP tomorrow about the self injury)

Many Thanks

Hi Sorted

From your previous posts you seem to be expecting to be transferred from IB to ESA in the very near future because your IB is due for re-assessment this month. The point I was trying to make was that you should not be surprised if this does not happen, in the near future, it is perfectly possible that you will transferred at any time between now and April 2014!

I'm afraid I'm not sure what you are looking for when you ask about the rules for being found Fit for Work. Strictly speaking, there are no rules for this as ESA tests whether you are not Fit for Work, and if you fail this test then you are by definition Fit for Work.

I need to correct one of your comments. The Assessment Rate is only payable if you appeal. If you do not appeal, then with regard to ESA, you receive no further payments.

Hi Gordon.

You say that it quite clear that significant number of claimants are being transfered, irrelevant of their assessment date.

Would you be so kind to explain as to how you came to conclution?

The reason I am asking is that there seams to be very little information on this subject avaliable.

Thing

We have numerous members on this forum and I have seen the same on others, who have been transferred well before the IB renewal date and others who have not yet been transferred, despite having renewal dates for 2011!
