Hi all,
I am just wondering in 1999 after a bad accident at work in 1997 I had to go to a big medical, and then I went to an Industrial Injury meeting which I was unsure what it was about only to be told that after the medical I had which was for DLA they also had awarded me the low amount of Industrial Injury Benefit for life and it states clearly for life. due to (The loss of faculty is impaired and lower back movements and you are 14% disabled from xxxx to life because of the loss of faculty ) Now what I would like to know or if anyone can help, can I use this as part of my tribunal to help fight an atos home medical as I will never be 100% ever again.Have lots of medical evidence to prove.I have had checks for this done myself over the years and if anything getting worse with age.

The problem is that ESA is based on your ability to carry out certain tasks, not your capapcity to carry out any particular job. Are you familiar with the ESA descriptors? You will be much more likely to be awarded ESA if you can clearly show that you meet the required threshold of these (15 points needed for ESA).

Hi Willie,

I'm afraid we are not qualified to deal with Industrial Injuries Benefit (IIB) as it's not within our remit, which means we're not qualified to give advice on it.

However, receipt of one disability related benefit can be used as evidence for another.

Your post is not clear in what you're asking, since medical boards are used to assess IIB,whilst DLA can be assessed by doctors, nurses, physiotherapists etc.

Also IIB and DLA Tribunals are heard by differently constituted panel members.

Thank You for the quick reply but this is a DLA tribunal that was adjourned for more evidence and a home medical which was a disaster ,It was full of discrepancy.
