Here we go again!! was created by smc
Well a white envelope from ATOS arrived on my doormat this morning and it had an ESA50 form in it.

It is only 8 months since my medical to move me from IB to ESA!!! So that means the stress was over me from July to November last year and now it starts all over again.

Nothing has really changed, I had to wait 6 months to see my consultant again and only saw him last week and I am now being referred to see another neurologist as consultant doesn't feel last one did enough and he is concerned as to my diagnosis being correct so am currently waiting for appointment and will also be back to see current consultant in November.

My question, apart from putting in the details of the new referral happening is it ok to copy what I said on my last ESA50?

Oh and are people being assessed so often? I am going to write to my MP as I really feel assessing people within a year is tantamount to harassment. When you have to wait so long for NHS appointments it really is ridiculous for much to have changed in under a year.

The minimum period for reassessment is 3 months. From what you have said, it sounds as if you have been sent the forms in good time for a 1 year review.

In principle you can copy what you wrote last time, however, if your condition has not changed, ATOS and indeed the DWP Decision Maker may consider whether you have had time to adapt to your limitations and may factor this into the review, so I would give some thought as to how you might address this.

As to being re-assessed so quickly, I am afraid 8 months is actually quite a long time in comparison to other claimants, see

How often will I be reviewed

My ESA85 said referral would be August and it is only June! When you are dealing with people who have chronic conditions it really is a waste of time and money to be assessing within a year.

I do see where you are coming from Gordon with regards to adapting to limitations but unfortunately the nature of my condition means there is little if any adapting that can be done whilst the doctors cannot find anything that can control the symptoms, all I can do is struggle through the days.

It is usual for the forms to be sent out 2-3 months in advance so that the decision can be made and your payment continue without a break.

I can understand that but the referral date on my ESA85 was 2 months early as it was. I know it would be happening anyway but bringing it forward really does nothing but stress claimants and the whole system is stressful enough!!!
