Brown envelope arrive today, been put in contribution based wrag group, should be in support group, due to not being able to walk 50metres without stopping because of severe pain. What should I do ask them to look at decision again or straight to appeal, I have ms and me.

We usually suggest that people go straight to appeal as a recon will be carried out anyway - so asking for one first just takes more time.

However, you need to remember that the mobility descriptor for the support group depends on your ability to mobilise rather than walk. The assessor is entitled to decide that you would be able to self-propell a wheelchair, even if you don't have one. Therefore you will need to provide reasons as to why you cannot do so (if this is the case).

would not be able to use wheelchair as have a lot of pain in arms, lymphodema in one.
walking causes lots of pain.
How do people get on as a rule on appeal.

Did you make this clear on your ESA50?

The statistics suggest that about 40% of appeals are found in favour of the claimant, the figure is higher for hearings that the claimant attends and even higher where they also have a qualified representative, they are significantly lower if the claimant does not attend the hearing.

Hi Lily321,

If you were recently awarded DLA HRM and HRC maybe you could get hold of a copy of the Decision Makers report and see if you can use it to your advantage as it may well confirm your mobility and phycical problems and you can thereafter, reiterate why you cannot use a manual wheelchair.
