Income based ESA - Eligibility was created by Inan
This is my first post so please be lenient with me if I get things wrong.
I have not worked since May 1999 when I was medically discharged suffering from post traumatic stress. Since that date I have received incapacity benefit. This was converted to ESA in May this year when I was placed in the WRAG group having received 24 points. I actually disagree with this and thought I should be placed in Support group. I have asked for a reconsideration in the 1st instance. I have now been summoned for a WFI at local jobcentre. One of my problems is that I suffer panic attacks in crowded places. I have asked for telephone interview but to date no reply - interview is 21st June. Whatever happens I will not be going as not willing to make myself more ill by attending. What will happen if I get no reply from my request and do not attend?
Also I am on IB ESA at moment - will I after 365 days be eligible for income based ESA - I only have an occupational pension (no savings) and am 60yrs old - I am sure I have read somewhere that occupational pensions are disregarded but now cannot find where I read it now.
I am completely disillusioned by the DWP as my illness which was being controlled is now a lot worse. I am almost at the point where I will say keep your money as I do not want to go back to really dark days of my illness.

Hello and welcome.

As you are new to b+W, you might find this helpful

Welcome to Benefits and Work

Unfortunately, the system demands that we still have to attend work focused interviews, even while appealing. If you don't do this you could lose the WRAG related portion of your ESA, so it is certainly worth continuing to try and get yur WFI carried out by phone.

Do I have to attend WFIs while appealing?

You will have 12 months contributary ESA, then your income will be assessed for income-related ESA (if not put into the support group by that stage). Occupational pensions count towards your income, but are also counted for those on contributary benefit - unless your pension was disregarded for your IB

Will my pension be disragarded for ESA?

Nothing on this board constitutes legal advice - always consult a professional about specific problems
