ESA APPEALING was created by doormat
my daughter is appealing the failing of medical for esa in the mean time remploy keeps sending for her to wfi but she has not gone she has now got a letter to ask a good reason for not attending and if she does not they will stop her money
job centre plus say she should not go but some one from the esa says that before she went on the sick she was put on the work programme so choose what benefit she is drawing she has to go on the programme for 2 year because she is on a work programme not wfi
remploy have said the only way round this is for them to ring me every month or so to see if everything is the same
does this sound right any help wecome

On the assumption that your daughter was found Fit for Work, then she is not required to partake in the Work Programme. This is the case even is she was previously forwarded on when receiving another benefit.

If she was placed in the WRAG and is appealing to be placed in the Support Group, then she does, having been forwarded on by JC+

The companies running the WP can be paid up to £14,000 for successfully placing somone in full time employment, so once they have your details, they can be reluctant to let go.

Only the DWP can sanction her benefit, however, they can only sanction the WRA component, which your daughter is not receiving while she is appealing.

thanks gordon i have told all on the telephone that she sould not be on the work programme but some say that the wfi is different to the work programme the esa people say they cannot help because she is only on the assessment rate the local job centre plus say she should go to work programme

Although WFIs are different from the Work Programme, see the following, the same basic rules apply, if she is not in the WRAG she shouldn't be called.

good luck with the appeal, i recently appealed ESA and it ended up going to a tribunal which i failed so i'm stuck on jobseekers allowance
