I am female and was also born in 1953, August, I now do not retire until November 2017, date changed for the 2nd time, there are not many situations when you wish you were a little older!! Had to give up a well paid job over 20 years ago because of major orthopaedic problems, now other parts of my anatomy are giving out due to the added strain. Just had by conversion from IB to ESA, put in WRAG but will be appealing, got my medical report very quickly but awaiting further documents. Only scored 15 points despite major mobility and upper limb problems (they were completely ignored), I also have Osteoporosis (again impact of that ignored). DWP was advised that a return to work is unlikely for at least 2 years and that I am unlikely to return to work in the longer term, if I win my appeal and get put in the support group does anyone know if the reassessment date will remain at 2 years or will change.

I wish i was older i was born 1953 but retirement date not till March 2018, all these potential employers will be queuing up to take me on if the worst happens.

It's likely to stay the same.

The re-assessment date is a recommendation and does not constitute part of the award as it does for DLA, as a result it is very unusual for a Tribunal panel to recommend a new date be set and even if they did, the DWP are under no obligation to follow it.

It is possible that a Decision Maker might take note of Tribunal Decision and update the date as a result, but there is no guarantee, and you also have to consider that a new date might be sooner than that already on your file.

Thanks for the information, it is better to have some idea of what might happen.

If I loose my appeal and stay in WRAG, I appreciate that my ESA CB will cease after 365 days, I would not be eligible for ESA IB, my husband works full time. If my condition continues to deteriorate (it is likely to do that more quickly if I have to attend Work Prograame etc) I am barely coping with daily activities as it is, what is the procedure for having my claim looked at again before the 2 years is up?

You would need to show, using new evidence, not previously presented as part of your appeal, that your condition has deteriorated or you have a new condition, that would qualify you for the Support Group, this being the case you would ask for a Supersession or re-assessment of your claim on this basis.

This evidence may need to be compelling, as the DWP appear to be taking a firmer stance regarding this process due to the number of ESA(CB) claimants making use of it currently.
