ESA Appeal - My Score sheet - help pls!

Hi all,

I've sent in an appeal for my ESA Wrag to support group. I suffer with ME and am extremely poorly. However, the medical examiner has stated this on my score sheet :

Zero for everything except:

Consciousness Fa 15 points
Personal Action lAb 9 points

I've not heard when my appeal will be, hubby is representing me, but in the meantime, I just wondered what the scores mean, etc. Can anyone advise me please? Many thanks.

You need 15 points to be awarded ESA (except in certain exceptional circumstances). How these points are allocated is explained in the B+W ESA guide.

As you have requested an oral hearing of your ESA appeal at which your husband will represent you, it may be in your best interests to request a domiciliary hearing if you are unable to attend in person.

The reason is that appeal tribunals will wish to hear directly from the appellant themselves as opposed to a representative. Although tribunals may listen to what a representative has to say, they will wish to question you directly about your medical condition and how it affects your ability to work.

Although tribunals are different in the way in which they approach hearings, from experience unless there is any further compelling (medical) evidence which will assist your appeal, representatives being present without the appellant will invariably have no more chance of success than a paper hearing where the appellant elects not to attend a hearing.

If you are too ill to attend a tribunal, in the absence of further (medical) evidence, a hearing at home will increase your chances of a successful appeal, but the Tribunals Service will require evidence from your GP that you would be unable to attend in person to consider a domiciliary hearing.
