I am on unemployment, income support & DLA and my aunt 95 is getting statepension/credits and AA.

2 things have recently happened, first I recieved an esa50 to fill in, second income support have just told me that had i claimed carers allowence i would of been exempt from the esa people and their forms, and that whoever i spoke to before (twice) should of told me this?!?

But if i dont claim carers allowence they Income support & esa, will not recognise me as providing 35+ hrs care as this to them is the proof?

My aunt requires a min of 49+ hrs a week, i struggle to cope with my own ilness and with my aunts needs i am at my limmits most of the time. should esa find against me i wont be able to conform to whatever it is i have to do, not only because of my aunts needs but because i wont be able to go into the environments they want without my safety and health being very seriously comprimised.

i am max'd out, both of us are in great distress, and the poeple who are suposed to help us are not

please advice

I assume that you are receiving IS because of Incapacity, all such claimanst are being transferred from IS to ESA.

What the DWP people are saying to you is that you have two options;

- You can be transferred to ESA, you can continue to claim Carers Allowance, providing your doing so does not impact on you meeting the ESA requirements, or

- You can claim Income Support as a carer rather than being transferred to ESA.

We can't advise as to which option would be better for you, you should seek face to face advice before making a decision.

I hope this explains it.
