Outcome of ATOS WCA was created by GAP23
Hello, my brother had a WCA in April 2011 and on 6 June 2011 got DWP decision that as he scored nil points at ATOS assessment he was not eligible for ESA. He appealed, won his Appeal and was put in WRAG and got increased WRAG rate backdated to the DWP decison on 6 June. At the same time he got another ESA50 to complete which he duly did and was called for a further ATOS WCA which took place on 24 April 2012. Since then he has not had any communication from DWP as to the outcome of his latest WCA and has continued to receive ESA WRAG (IR). He is anxious about not knowing the outcome and worried that if he failed the WCA again and went to Appeal his ESA would be reduced to assessment rate. I have advised him not to chase the DWP at the moment ' no news is good news' as he is still getting ESA at WRAG rate. Is this a sensible approach? Thank you Maureen

There is no right or wrong way to approach this, contacting the DWP will have no impact on the Decision process, so it really boils down to whether your brother is more comfortable knowing what is happening or not.

Having reflected on your advice and knowing how anxious my brother is I think he would probably be more comfortable knowing what is happening so we will ring DWP tomorrow. My thanks to you and all the other very hard working Mods on this Forum. Maureen
