Hi ,
Just a thought I won my dla tribunal unanimous decision and noted that the clerk was taking notes.

I am now in appeal stage of ESA can I request the notes taken from the dla appeal and if so would I be able to use this alongside other evidence to help my ESA appeal??

Yes,You can ask for copies of everything that they have and what has been written down etc etc and you should.

As far as I am aware you need to request the Record of Proceedings within one month of your appeal hearing, so you may be too late to do this.

The other issue is that the DLA criteria are not as strict as the the ESA ones, so a DLA award does not necessarily lead to an ESA one.

The clerk does not take notes during a tribunal hearing as this is purely a matter for the judge.

Although the clerk may have appeared to take notes, it is likely that he/she was doing administrative work which had no connection with the hearing. You can however still request a record of the proceedings, which are retained for a period of eighteen months following the date of your DLA hearing
