Hi two questions - I have been placed in the wrag group and are appealing to be placed in the support group and currently waiting for the dwp to look at my claim again to see if they can change their decision by revising my claim – in fact it’s been since January 6 months since I submitted my appeal form gl22 not the 3 months I previously thought 6 months exactly has passed and still waiting for my claim to be looked at. I telephoned the dwp today – which I was put through to a contact centre in Wales who took my telephone number for the dwp to ring me back which they did 3 and half hours later . The Gent told me it could be a further 7 months until my claim could be revised and looked at again and a further 6 to 8 months for it to go to appeal? How ridiculous is that??? so on worse scenario it could be up to nearly two years before I will no ether way what the outcome of my appeal will be so in the mean time it looks like I will have to go on job seekers allowance for over 6 months or longer as my the wrag element I was awarded on runs out in December does this seem very unfair to you experts?
I also asked for a 2nd time could I have a statement of reason the first time I asked I was sent a med 4 form this 2nd time I’ve asked for a sor I was told there isn’t one in my case and that I have got all the information in the original decision letter which I received in January – all this letter says is that the officer is satisfied that I have scored 15 or more points and have been placed in the wrag group that’s all nothing about anything else which explains how they came to the decision how can I put my points across successfully if I don’t know exactly what I have scored or not scored and how they came to their decision Do you think that the dwp Failure to provide a full written statement of reason and failure to provide adequate consultation and information -will go against the dwp this whole thing seems very unfair I hope the tribunal sees it this way to whats your thoughts

Whilst there is no specific timescale for the DWP to complete a Reconsideration within, they none the less should complete it within a reasonable timescale.

As it is now six months you may want to make a formal complaint

Complaining to the DWP

You may also want to involve your MP

Contacting your MP

With regard the Statement of Reasons. It is possible that one was not produced when a Decision was made on your claim, but even if this is so, the DWP have a legal obligation to create one based on the other documents used to make the Decision. Unfortunately, enforcing this requirement is becoming increasinglky difficult and often still results in failure.

The only thing I can suggest as an alternative is to make a formal Subject Access Request for all of the documents they hold on you, there is a guide to doing this on the following link
