I wonder if I could be given some guidance please.

I have been transferred from the SG to the WRAG and immediately appealed utilising your template asking that I go straight to Tribunal requesting the material used as to how the decision was reached.

I have now received a letter from the DWP stating they will look at the decision I have appealed against and if appropriate they will revise the decision in my favour, and asked me to supply any further evidence I have.

It then goes on to say that if they cannot revise the decision in my favour they would send my appeal letter and papers giving their reasons and evidence for the decision to HM Courts and Tribunals Service and they would send me a copy.

My understanding was that I had asked them to supply me with the material following which I would submit my appeal to the Tribunal, but it seems they want to "observe" my hand first!

Surely if I had sent in my appeal as well as a Data request, they should comply with that. I feel I am being pushed blindly into a corner and I need to assess what they base their decision on so I can take my time to respond accordingly?

The DWP are required to carry out a Reconsideration of your claim before it can be passed to the Tribunal Service for an appeal.

If you have additional evidence or believe they have not interpretted your existing evidence correctly, then there is an opportunity for your to present this to the DWP Decision Maker as part of this process, doing so may result in the original Decision being changed.

You are not obliged to take part in this process, but your papers will not be passed to the Tribunal Service until it has been completed.

Thank you for your swift response Gordon, but I am all the more confused now :blink:

I submitted the GL24 following transfer and the site guidelines indicated I could either 1) Ask for a revision or 2) go straight to appeal without a revision.

The guidelines seem to suggest it would be better to go straight to appeal which is what I did. When I submitted the GL24 I also submitted a Data Request form to enable me to draft my appeal.

Are you saying that unless I comply with THEIR request, my appeal will not be forwarded to the Tribunal at all? I'm sorry if I haven't grasped this - all I wanted is a right to appeal, to a Tribunal - can it be I will be denied?

I am in bits over this and I cannot make head nor tail of the situation.

It is mandatory for DWP to carry out a reconsideration as part of the appeal process - this is one reason why we do not suggest that people ask for a 'stand alone' recon if they intend to appeal anyway. Your papers can only be passed to the Tribunal service once this recon has taken place.

If you disagree with a DWP Decision you have two options;

You can ask for a Reconsideratiom, a new Decision Maker will look at the evidence again and any that you supply specifically for the process. They will either find in your favour or uphold the original Decision, if the latter then you can lodge an appeal, or

You can appeal, the DWP are first required to carry out a Reconsideration, if they uphold the original Decision they will pass your papers onto the Tribunal Service for a hearing to be convened.

We advise claimants to appeal rather than ask for a Reconsideration for a number of reasons.

If this is an ESA Fit for Work Decision, then a claimant will only be paid the assessment rate when they lodge an appeal, not if they only ask for a Reconsideration.

Most claimants, have already submitted all of the evidence readily available to them as part of their original submission, and therefore have little if any new evidence to present for the Reconsideration. They may be able to acquire additional evidence, but not on the timescales needed for a Reconsideration.

If you ask for a Reconsideration and then appeal, the DWP are still required to carry out a (second) Reconsideration, before passing your papers on, substantially extending the process.

With regard your documents.

When the DWP complete their Reconsideration process, they will send a packet of papers which should contain all of the documents they used to make their Decision, however, you can request these documents now, either by phoning or writing to your local DWP office, and they should supply them in a couple of weeks, this request would be seperate from the appel process.

This is rather strange (albeit pleasantly so)

I did not make any response to the letter from the DM and resigned myself to preparing for a tribunal then at the weekend I received a letter stating I was being transferred to the SG.

I must say, I never expected this following on from previous experience!
