ESA Support Group to WRAG was created by walterwall
Hi , I Have been transferred form ESA Support Goup to WRAG following a medical. This is because of the new descriptors. This means I will lose my award as I am now subject to the new 365 day rule and do not qualify for Income Based ESA. My questions are: 1,what happens to those who have a new condition or their condition worsens during the time they are in WRAG? 2: what happens to those of us who use up their 365days and subsequently fit the descriptors for the Support Group can you re apply for contribution based ESA once he time limit is up on the basis that your condition has worsened? 3, for those people who are able to go back to work after being on ESA is it possible for them to make a future claim for ESA(CB) after a certain time or after a certain period of time in which you have been back in work? thanks

Just to confirm, even though you have been transferred into the WRAG, unless you were previously in that group, you will have 365 days in the WRAG while receiving ESA(CB), as time in the Support Group does not count towards the total.

In answer to your questions'

1. If your condition deteriorates such that you believe you meet the criteria for the Support Group, you can request a Supersession (on this basis), which will result in you being re-assessed, if placed in the Support Group, your payments will be re-instated if stopped, or, the count will be paused if you are still receiving payment while in the WRAG.

2. If you, at some time in the future, believe you neet the criteria for the Support Group, and you have remained eligible for ESA during the interim, you can request a Supersession as above.

3. You can re-qualify for ESA(CB) by meeting the NI Contribution requirements, how long this might take will depend on your earnings, you cannot make a new claim within 12 weeks of losing entitlement to payment on the current claim.

There are a lot of use out here like yourself, I believe they are placing all contribution based claiments in WRAG so they dont have to pay us, or train us or probabaly pay our stamps. We can quietly languish here while they claim they have got many of ESA and the jobless number is falling. I hope somebody outthere can challenge the decisions based on Wealth not Health. I use the word wealth loosley as most of us have only small incomes or savings.

annken, we know that the stated purpose of the WRB is to save money. However I have certainly seen/heard people being put into the Support Group who would probably not be entitled to income related ESA.

NI contributions will be paid on the claimant's behalf as long as they continue to be classed as meeting the ESA criteria.

thanks for the contributions and advice. spoke to dwp yesterday. the person i spoke to had little knowledge of how the system is operating and could not give satisfactory anwers to any of my questions. it seems to me that they are not given sufficient training to deal with this complicated benefit. all she said was that i could appeal and when i talked about the change in the descriptors in the latest ESA50 i could tell she did not know what i was on about.
