esa wca medical delay

esa wca medical delay was created by steve64
Can anyone advise how long it is at present taking from return of esa50 form to wca medical, I returned my esa50 8 weeks ago and still not heard anything from them as to date of medical it seems a long time???

The system is overhwelmed and everything is taking longer than usual. In my case, it took more than 5 months until I had my 'medcal'.

I think it depends where you live. A friend of mine return there form a week of so early and received a telephone call from ATOS for a medical the day after his orginal return date.

Can anyone tell me if there is a maximum time by-which ATOS have to arrange a medical?

They have scheduled one 6 months after return of my esa50.

During that time I have additional illness diagnosed and also have a series of 4 operations planned for my hands. None of this was mentioned in my esa50 it was sent in such a long time ago!

I am afraid the legislation does not define any requirements or even guidelines as to how long any of the stages of the ESA process should take, even the Assessment period which is defined as being 13 weeks, still does not require a Decision to be made within that period.

However, that does not excuse the DWP for taking so long to process your claim, you can make a complaint and even claim maladministration, I would also contact your MP over the matter, see

Hi tbS,

I agree with Gordon !!!

You could also update ATOS on your current condition by sending any fresh evidence to the ATOS address that you sent your ESA50 to, asking that it is taken into consideration in your pending assessment.

You should only send copies, put your Name, NI Number and DOB on any seperate pages, see :

You could also E-mail ATOS : This email address is being protected from spambots. You need JavaScript enabled to view it.

It may also be wise to send copies FAO The ESA Decision Maker at the address of the Benefits Office that deals with your ESA.

You can also take copies of any fresh current evidence along to your face to face assessment, and hand it to the ATOS HCP before the assessment begins, they are supposed to read it.
