Hi

On Nov 11th 2010 i was awarded DLA until Nov 11th 2012 at lower rate mobility and middle rate care.

last week i recieved a DLA claim renweal pack which is some 4 months earlier than the end of claim date of 11th Nov 2010 and this seems unusual to me to be so early.

1. I want to clarify the FAQ you have posted regarding the issue of early sends of DLA renewal forms:
Your FAQ suggests that If i send in the renewal for DLA claim form now there is a possibility that any of the content of the form can affect my current DLA award NOW and i could see a reduction or an increase in my DLA award occur before the end of ward / award renewal date in Nov 2012 ? Could you confirm that my understanding of your FAQ is correct ?

2. I understand PIP is due for introduction sometime around April 2013. If my DLA award is successful, can i expect a future migration into the PIP similar to the introduction to the ESA migration process that occurred a while ago ? I can't find any details about what to expect regarding the intro process of PIP.

thanks for your time and attention

DLA renewals are usually sent out about four months before, it used to be six, the award ends, this is to allow time for your to complete the form and return it, and the DWP to collect any further evidence they need to make a Decision.

1. DLA awards apply from the date that a Decision on the claim is made. If you return you form early and they quickly make a Decision then your existing award would be cut short. This couuld be to your adavantage if your award is increased and obviously not, if it is reduced.

If you return the papaerwork later and the DWP are tardy in making a Decision, then you could have a period where you receive no payments, between the end of your current award and the start of a new award.

2. All DLA claimants of working age will be transferred to PIP over what will probably be a three year period starting in 2014, there will be a trial and a switch of new claims to PIP in 2013.

At the moment there are only limited details of the transfer, you can read these via an article on PIP in the Spotlight area, at the top of the forum thread list. HERE

where you say:

"If you return the papaerwork later and the DLA are tardy in making a Decision, then you could have a period where you receive no payments, between the end of your current award and the start of a new award."

However am i correct in thinking that the DLA must always backdate payments in relation to the date of receipt of an application form ? So i may experience a period of non-payments, but if my award is successful, i should receive all due back-payments in full which would cover the no payment period you indicate ?

thanks

If the forms are returned before the renewal date, then I believe back payments would be due.
