Med 3 and was told by DWP no time limit on appeals

Hi
Firstly: Would you know how ATOS would have got hold of a (MED 3)would they have asked my GP to send one? the last MED I sent to the DWP was a MED4 2005 which they asked me to get from my GP and to send it to them!! and can I ask the DWP for a copy of this MED3? I am in the process of appealing against the decision of putting me in the WRAG rather than the support group. and requested a statment of reasons how they had come to that decision, I also asked for the medical Report which stated the MED 3 and my ESA50 had been used in evidence in this case no mention of all the Medical Reports I sent in as evidence???

Secondly: On Friday 13th June 2012 I phoned the DWP up to ask if they would extend my 4 weeks appeal time which ends on the 20th June 2012, I asked them this because I wanted to seek legal advise and representation at appeal, the person took details and said someone would phone you on Monday 16th June between 9am-11am no one was avaiable at present, sure enough i got a phone call at 8.30 am I asked her if this was possible for extension and she said and I quote that there was (NO TIME LIMIT TO GET YOUR APPEALS in ANY MORE)??? I did Tape all this conversation and got her name I also asked for a letter of confirmation to be sent but she said there was no need that is the new rule??? luckly I have got representation, filled form in this morning and sent it Recorded delivery 1st Class (dont trust that one)??? :unsure:

1) I cannot work out how ATOS could have got hold of a Med3 ('fitnote') unless you sent one in. I wonder if this refers to a different piece of DWP paperwork that happens to have the same number?

2) This is the first I have heard about unlimited time to appeal. Well done for getting evidence of the conversation!

Appeal times are set in legislative documents which as far as I am aware have not been amended, however, whilst the normal period to submit an appeal is one month, it is possible to submit a late appeal up to 13 months after the date of the appeal, providing Good Cause is given for it being late and that Good Cause is accepted.

The potential issue here, is where a late appeal is accepted by the DWP without Good Cause, but not accepted by the Tribunal Service because no reason has been given, whilst this may be an unlikely scenario, I would recommend claimants to stick to the advice given and lodge your appeals within the guidance.

I am still confused about the Med3 that Atos say on there Medical report that they had took into consideration in my case along with the esa50, like i mentioned the last Med i sent in was 2005 a (med4)which a made a copy of, so where did they get a med 3 from since i last sent a med in my conditions have got worse! do you think if i phone up they will send me a copy of this med3 i just dont trust any one connected to the DWP, :silly:
