Hi
I am appealing after being put in wrag feel I should be in support group, however if I were to lose my appeal could I apply again for ESA contribution based? Not sure about this.

This is not straight-forward and depends on how many NI contributions you made in the previous 2 tax years.

If you are left in the WRAG after your appeal, you'll still have the full 365 days on ESA(CB) before your payments will stop.

If you don't qualify for ESA(IR), then you can make a new claim for ESA(CB), however, you need to close your old claim and wait for 12 weeks before making a new application, or this new claim will be linked to the old one. This will prevent you asking to be re-assessed for the Support Group at a later date.

You need to satisfy all three of the Contribution requirements, the first will be the most problem as it is based on your NI Contributions (not Credits). If you were previously on IB or SDA, or have been claiming ESA for more than two years you won't qualify, less than two years, and you may, but it will depend on when you last worked and how much you earned.

As I retired as a WRO in 2005, I am not up-to-date on ESA. I'm sure one of our other moderators online will reply.
