Hi .
My ESA(CB) is ending soon and i am not entitled to ESA(IR) because my husband gets a small occuptional pension.
Despite having a tribunal i still did not fit the descriptors at the moment although i am waiting to see a consultant on a health issure soon.
I have to say it makes me livid that i will lose my benefit and i have 33 points on my Atos medicals.(ESA CB).
There seems no provision for people like me who are sick with serious medical conditions 1.e epilepsy. 4 discs out in my back, ( chronic back ache) due to 20 years of nursing, Arthiritis in hands ( fingers are all bent over etc) neck and feet, back, fibrmylega, underactive throid gland and chronic depression, and there is more.... and im supposed to move towards looking for work??
I am in the ESA(work group) but i have never been called into the job center and my ATOS Prognosis is 'a return to work is unlikely in the longer term and that my functional ability will only deteriorate in the foreseeable future!
I used to be an Occuptional Health Nurse and i can say from experience i am not employable , at best im drugged out of head with all the medication i have to take for pain etc,
I want to know how to approach what i believe is a total injustice by the DWP and what others in my situation are feeling and what they are doing? My husband is my full time carer.

Hi jc
I'm in the same boat as you cont based ESA put in wrag, I have me,ms heart prob, under active thyroid to name but a few.
I really do not understand this, why when we have so many problems are we placed in wrag ? I have to attend an interview at job centre next week, I have appealed against their decision, I am just too I'll to work and all the stress has made my Ms worse.
Lily.

There will be a lot of people in th same position. Unfortunately, the ability to do this has now been enacted in law, there is no abiity to appeal against it

As you have already had a Tribunal concerning your being placed in the WRAG, there is no opportunity for you to pursue your current claim further.

If your condition deriorates, to the point where you then believe you meet the criteria for the Support Group, and you have maintained you eigibility for ESA in the interim, then you can ask to be re-assessed and if placed in the Support Group, your ESA payments will be re-instated and will remain in payment while you remain in the Support Group.

Thanks for the replies , especially Gordon.
Whatever happens it is my intention to lobby, I do not believe sick people should be treated like this.
