Ah thanks Gorden kinda settles a few things but i dnt get IS cos apprently they say i earn too much to get IS with incap and DLA (confusing i know!) so i dont know why JC said i will be on ir esa when it might be different, now you see why i confused!

Hi R,

It is entirely possible for claimants to receive Incapacity Benefit, with an income support "Top up" because they are entitled to "Disabilty Premiums", due to the fact that they receive Middle or Higher Rate of DLA Care Component.

Likewise, it is possible for a claimant in such circumstances to receive Contributary ESA, with an Income Related ESA "Top Up".

As previously advised if succesfully transferred to ESA you will receive no less than you receive now, under "Transitional Protection"
