Hi there,

My step-father is off sick from work after having surgery for cancer. He want to apply for esa etc, until he recovers.

I am currently on incapacity benefit and dla for severe long standing health problems and am awaiting transfer over to esa.

My questions are:- Would he be entitled to any benefits help if I already receive benefits, and my mother receives a pension. He also receives a small retired railway pension as well. Would our incomes be combined when being assessed and would it be considered too much? I really am not sure what exactly is taken into account.

Also can you tell me if he applies for esa, would the fact that we live at the same address (have different surnames) flag up the fact that my reassessment date for transfer from IB to esa has passed.

Any advice would be much appreciated.

As you are, I assume, a non-dependant adult, your benefit entitlement should have no effect on any claim that your farther might make.

Whether your mothers pension, will be taken into account will depend on whether he is eligible for Contribution Based ESA or not, to this end they might want to see a suitable advisor who can go over their situation in detail. See

His making a claim for ESA should have no impact on when you will be transferred from IB to ESA, the DWP are woring to a plan, it's not clear what that plan is, but they are unlikely to change it in the circumstances you describe :)

I just thought that as we have same address that it would flag my name up, so its a relief to know that it wouldn't (although how is that possible and does it apply to both esa and dla?)

Does the fact that he has worked for 40+ years decide whether he will get contributory or income based esa. As he has no income coming in at all, he will probably try for housing benefit also, do you know if my benefits and mothers pension will be taken into account when applying for this?

Its curious that after all this time that the DWP still don't seem to have a clear plan to anything, ha. One last thing, is there a time limit on how long you would leave it after my assessment date has passed, to contact the DWP. Would I get into trouble if say 2mths had passed and I had not contacted the dwp.?

It is likely that he will be eligible for ESA(CB), but it will depend on his NI Contribution during the last two full tax years.

Whether your mothers pension is included will depend on what type of ESA he can claim, a question I cannot answer on the forum, hence my suggestion that they get face to face advice.

You are under no obligation to contact the DWP regarding your transfer, in fact, I suspect the advice from other members would be to leave it alone.

Hi gordon,

Just out of curiosity, what has been the longest amount of time that has passed for someone awaiting transfer from IB to ESA.

Sorry if Im repeating myself but why do you think my fathers esa/dla claim would not flag up my claim and cause them to take action on it?

Perhaps one of our members who has not been transferred would care to comment.

Am I 100% certain that it won't, then I would answer no, however, I can think of no reason why it should.

The DWP are working from a list, we already know that claimants that might have expected to be transferred in 2014 have already gone through the process, and there are certainly claimants who would have expected to be transferred last year, when the process started, who have not been.

All I can say is that you will be transferred when the DWP decide to transfer you, all that you can do is be prepared for when it happens.
