Apeals and trauma was created by sally-jane
Hiya one and all.
I am writing this not about myself but about a friend who has just undergone an apeal and thought I would mention about the trauma she was faced with.
(I am in the SG & await an ESA to complete again next year)
We live in a seaside rural location & my friend had to ask for assistance to get to appeal centre via a friend, the location 40 miles away, buses , a joke & would take 3 hours to get there, but friend unable to mobilise to a bus, no transport, other than a friend to get her there.
My friend went & met her CAB representative there, complete with as much medical evidence etc she could muster. 3 people on panel plus a notetaker. (I understand a recording was not asked for). My friend was shouted at & made to feel stupid. One of the panel was supercilious with a wide grin that was unerving, the famale bomberded questions in an unpleasant manner. My friend has real physical/anxiety probs & does not deal with peoplevery well, physically not good nor otherwise really strong enough to ever undertake work in any aspect- thats if anyone was daft enough to give her a job.
Result - go to work, everyone has stress, deal with it,its tough for all,not just you. You must attend Jobseekers next day or money will cease. She asked if it could be moved to Monday as it will take her days to get over this meeting. Told, - maybe if you ring & make an apt & get there, no further changes permitted. CAB representative explained when they got outside, nothing else could be done, a bit shocked at the result but get a job & get over it.

I feel the whole thing is bonkers & am really worried about her state of mental health now let alone financial aspect of it all.

If anyone had a semblence of common sense they could see she is not a fit candidate to undertake any type of work/activity.
God knows what will become of us all when DLA starts the whole sorry circus to add to this ESA nonsense.

What if anything is out there to help this poor person.

I'm sorry to hear that your friend had such a poor experience at their Tribunal, fortunately this tends to be the exception rather than the rule.

As they already have a representative, there is little that we can comment on, they can make a complaint regarding the behaviour of the panel members, see

Complaining to the Tribunal Service

They can only pursue their claim further if they can show that there has been an Error of Law in the proceedings, their representative should be aware of what to do in these circumstances.

They should be able to make a new claim for ESA, rather than having to claim JSA, providing their GP is willing to declare them Unfit for Work.
