Incontinence DLA changes is PiP already here? was created by Carolyn Amey
Has anyone noticed recent changes to the new DLA forms in line with PIP?

I have Crohn’s disease, third bowel resection due any time.
I got DLA renewal forms and I notice a change in needing someone with you when you are out.
It no longer covers

- because of fear or anxiety over finding toilets-.

This point was won in case law a few years ago regarding bowel incontinence but now it seams to have been thrown out of DLA and is also thrown out of PiP.
So are certain parts of PiP already in use in DLA?

Did I read it right? Is the hard won case of anxiety over losing your human dignity through bowel incontinence in public no longer included in needing someone with you when you out? Even if you suffer bowel incontinence almost daily?

Anyone know the law on bowel incontinence? My blood pressure is through the roof trying plough through miles of Dave’s missives let alone the legal volumes.

I also have emphysema and arthritis and I often need help getting to toilets in time, as I only walk slowly.
I can’t find a definition of what slow walking is except it’s often too slow for me.

I believe the latest DLA forms are dated October 2011, and were amended to reflect changes in the way that claimants with sensory impairments needed to be handled.

The PIP criteria have not been agreed, and even if they were, PIP and DLA are different benefits, and as such, the criteria for PIP could not be applied to DLA.

I can't comment on the specific case law you refer to, but a list of current DLA case law is available on the following link

You should also have a look at our DLA Claim guides

Thank you for that link Gordon, it includes the case I mentioned
CDLA/217/2009

I know DLA and PIP are different and maybe I have looked at too much stuff but its not in PIP and I wonder if the odd new reg is sneeking into DLA already.

Also wonder if new awards will be up for the work capacity test from April or left for the length of the award.

Its just too much stress on people and so very little information and far too much scare mongering.

Now I am confused - there is no WCA for DLA or PIP (as they are not 'out of work' benefits)

Current claimants of DLA will not start to be reassessed for PIP until sometime in 2013. Assessing DLA claimants of working age, i.e. those 16-64 years of will take from 2013 to 2016.
