IB to ESA transfer question

Hi

Wife got the dreaded brown envelope last Friday to say they will be telephoning soon to explain about the migration to ESA.

Two questions rearly

1/ Does my wife have to speak to them or will the ESA50 just be sent out away? She is worried she might say something they will use againt her.

2/ I know that an award of ESA can to made based on the information contained in the ESA50 and supporting evidence without the need for a medical. Is the reverse possible. Can you be found fit for work based on the the form alone? Do you have to have a face to face medical before you can be found fit for work.

The welfare rights officer at our local council who helps with the forms normally has been made redundant, so we will have to gon it alone this time with the help of the good people on here.

1) Your wife does not have to talk to anyone on the phone, the process will roll on whatever. Of course, there might be times when it would be beneficial to receive a call, but I don't think this is one of them.

2) ESA cannot be refused without a face-to-face assessment.

2. No, you cannot be found Fit for Work without a face to face assessment being scheduled.

Thank you, I am glad that is the case, at least we will get a chance for the ATOS to see how bad she rearly is.

But I suppose that means nothing these days.

Hello again,

I am waiting for a medical statement from the doctor (which is costing me £33, never had to pay before) to send with the ESA50.

I understand it is advisable to send a copy of ESA50 to the DM at DWP. Whould a copy of the supporting evidence go to them as well .

Is it the address on the letter that came advising about the migration you send it to and do you need to enclose a covering letter saying when you have sent it to them?

If you are going to send them the ESA50, then send them a copy of all of your evidence as well.

Mark it for the attention of the Decision Maker, and send it to the DWP office managing your transfer. Make sure each page has your name and National Insurance Number on it.

A covering letter is a good idea.
