Whether to re-send evidence? was created by Paul58
Hello. First post. Joined and also paid for the pdf docs. Searched the site, faq's and pdf's.
I've been put in the WRAG group, without a medical. Using your site and doc's (Great help! Thanks.) I've appealed to be put in the Support Group. Got what I assume is the standard reply letter today. It says, 'If you have further evidence... etc'. They obviously have all my evidence included with my ESA50. I seem to remember reading somewhere on here that all my evidence should be resubmitted every time I deal with them. So, should I resubmit or trust they'll re-read my original. I have nothing further to send them. Many thanks. Paul

Hi P58,

It will do no harm to reiterate how you feel that you qualify for entry to the SG.

It will be a different more senior DM that does the automatic reconsideration, so you could redraw his/her attention to evidence that you feel has been overlooked in the original decision to place you into the WRAG.

Of course, as always, it is entirely upto you. :)

Just to update. Rewrote and sent a few of the main points I wanted to highlight, asking they be read instead of, or with, the originals. I have both mental and physical problems, but said for the moment I was appealing mainly on a few of the mental issues I have, until I got all the reports back I'd asked for under FOI - which I still haven't got 26 working days later. Got a medical report form today from Belfast, and I presume I'm going in the support group. Says I meet the criteria for LCW, and a return to work is unlikely in the long term. Funny thing is, it says the bloke making this decision is a Physiotherapist? Here's hoping I get a letter confirming I'm in support group. A big thank-you to this site, yourself, and all who contribute. Paul

ATOS use doctors, nurses, midwives and physiotherapists to carry out the assessments.

I don't want to burst your bubble - but 'limited capacity for work' can mean WRAG (limited capacity for work related activity = support group)

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi P58,

If it states that "I meet the criteria for LCW," LCW means Limited Capability for Work, that only places you into The WRAG of ESA.

To be placed into The Support Group, you must be classed as having LCWRA, Limited Capability for Work Related Activity.

Further, "a return to work is unlikely in the long term", is the prognosis ( recommended length of the WRAG award)

Thanks for that. I think. Now I'm on a downer!
Could I ask what this part means, please?
The client has a significant level of disability due to Multiple Conditions. such that they would have limited capability for work. Likely to satisfy threshold for physical and mental health descriptors.
Pleas tell me that's good news.
Paul.
