Hi WD,

It could only go against you if the use of the PDF ESA50 was contradictory to the limitations that you are stating that you suffer with, to ATOS/DWP.

For example, unable to use a keyboard, not computer literate, learning difficulties, etc, etc, etc.

If a claimant did have limitations that prevented them from filling in the PDF ESA50 themselves, there is nothing wrong with getting someone else to fill in the form on their behalf, and stating this in the PDF ESA50, giving reasons.

After looking for the Letter template requesting to have medical recorded I have come across 2 versions, which is the more up to date?

Version 1 (Starting as below)

Name:

National insurance number:
WCA medical date:
WCA medical venue:

Re: recording of my face-to-face work capability assessment


I wish my forthcoming face-to-face work capability assessment to be recorded and to be provided with a copy of that recording.

I understand that Atos will provide the equipment and carry out the recording on my behalf. This was confirmed by the DWP Central FoI Team in a response dated 24 January 2012, your reference: VTR 2714-3878. This stated that:

“Provision is currently available for the recording of assessments upon request by the claimant to the office which administers the claim for benefit and Atos Healthcare. In these circumstances,

Atos Healthcare will provide the requisite audio recording equipment, which
will provide each party with a recording of the medical assessment.”




Version 2 (Starting as below) which is a 2 page letter


Re: having my assessment recorded

I wish to have my work capability face-to-face assessment recorded and I understand that this will be done by Atos using dual recording facilities and at no cost to me, as has repeatedly been stated by the minister of state for employment, Chris Grayling. If recording facilities are not available on the date of my assessment, I wish to have it postponed until they are.

Right to a recording
In a debate on the work capability assessment on 1 February 2012, Grayling told MPs that:

“On audio recording, we will offer everyone who wants it the opportunity to have their session recorded.” (Hansard citation: HC Deb, 1 February 2012, c291WH)

There is a copy of the letter in each of the ESA Claim guides and a Word version of the letter, which is also in the ESA section of the Members Area.

As far as I can tell, they are all the same version, and are the same as the version 2 of the letter that you refer to in your previous post. Is is it possible that you have an old version of the guides?
