How much more do they need? was created by rowantree
Any ideas for this scenario... My apologies if I am not following correct forum protocol, but this is all new to me and I am beside myself with worry over this.I have been on IB for sometime and received notice that had to fill in form assessment for conversion to ESA. No ,medical and result was ( thanks to your guide) scored at least 15. As a result placed into WRAG. Followed what I had read here and have informed DWP I would like a revision and also request an Appeal. So far I have heard nothing other than DWP sent an appeal form and a copy of ESA50A which said not likely to work for 2 years .
My GP has now provided a letter saying I am unfit for work and in his opinion unfit for any assessment or proposed tribunal. I think I fit the 'exceptional'clause in relation to being found fit for work and should qualify for the support group. I will send this tomorrow first class recorded etc.
I just wondered if any notice is taken of the GP's opinion...and will I still have to attend WRAG assessments? And sorry to be long winded can anyone tell me what these entail?

Hello and welcome to the forum.

Welcome to Benefits and Work

Your GPs opinion will carry more weight if it refers directly to the Support Group criteria that you feel apply to you. I don't know whether his letter wil be able to save you from a prolonged appeal process :(

You are obliged to undertake WFIs while appealing but it is possible to have these over the phone or even in your own home. You should wait until the first appointment letter arrives and then phone to speak to the advisor concerned.

Do I have to undertake WFIs while appealing?

Hi r,

Firstly, have you only requested a "revision" (reconsideration) or have you submitted an appeal, using GL24 form which can be downloaded from the link on this FAQ ? :

How to submit an appeal

If you have submitted an appeal an automatic reconsideration will be carried out by a different DM to the one that made the original WRAG decision.

If you have only requested a reconsideration, and the decision is not changed in your favour, you will then have to submit an appeal as a seperate action.

When you state that you were sent the ESA50A, do you actually mean the ESA85A ?

See :

ESA Forms

ESA medical – what forms to ask for?

As you have been placed in the WRAG, you are classed as being "unfit for work" ( Limited Capability for Work) LCW.

If you wish to be placed into the Support Group, you need to be classed as having (Limited Capability for Work Related Activity) LCWRA.

Work related activity obviously includes WFI's and WRA.

If you wish to enter the Support Group on The Exceptional Circumstances rule, the "burden of proof" is on you to prove it, whereas if you qualify under the SG descriptors, the "burden of proof" in on the DWP DM.

See :

Qualifying for the Support Group

You may also wish to review our : ESA Guides

The DWP DM is supposed to take into account all evidence at his disposal.
