ESA forms having to be completed twice?

Hi ,

I was wondering if its normal to be asked to do the ESA50 form twice? i was asked to fill it in 3 months ago,then to my surprise & upset,I was asked to fill it in again 1 month ago. i rang the job center & they said it was normal to be asked to do it twice, i really dont think its fair that i have to do this, i have problems writing in pen for long. i researched esa a lot, never seen anything about having to do it twice.

the job center said it was 1 form for them & 1 for atos,

Have you received a decision on an award of ESA, as a result of filling in and returning the first ESA50 3 months ago ?

Hi S,

As you have not responded to my question.

You should only receive a second ESA50, once you have received a full assessment (ESA WCA), you have been given an award of ESA, and are being reassessed, after the recommended length of the award has elapsed.

What you have been told regarding one copy for ATOS and one for the DWP, is utter bunkum.

It sounds as if your first ESA50 may have been lost.

Did you send it by recorded delivery ?, can you prove that it was delivered?

If you can prove that it was delivered to ATOS by the deadline, then there may be a possible breach of The Data Protection Act 1998.

If this is the case, you may wish to complain to the DWP, and your M.P.

With regards to your problems using a pen, have you considered using the PDF ESA50, which can be downloaded and saved to your PC from the link on this FAQ :

It would be advisable to fill in the most current ESA50, (Or PDF ESA50) and return it to ATOS by the deadline given, as failure to return it on time, can result in loss of your benefit.

I know this may seem unfair, but it may be in your best interests, until you can gain some clarity on the situation, in writing.

Hi Bro58,

Thanks for your informative reply,i didnt know there was a pdf of esa i will use that next time.

Ok i will try & explain the full story...i was sent an esa form at the end of june,saying they wanted to asses me for esa....i returned esa50 to the jobcenter plus mid july ,then after 2 weeks they sent me a form from the incapacity people saying "please give us your dr`s address in relation to you reclaiming incapacity benefit" which made no sense to me, as i thought i was been assesed for esa..i filled it in & returned anyway....a month ago they sent me esa 50 again,but this time from atos saying fill it in ,u have a month, it said no reason why i had to do it again....I`ve sent it now anyway....
I`ve had no letters saying i have esa whatsoever,the only thing they`ve done is send me the 2 forms....i`ve had no medicals or other letters off them.

I sent them both recorded delivery & have the receipts,

Confused by their behaviour,

Hi S,

The ESA50 should always be sent to you by ATOS, not JCP.

Likewise, it should always be returned to ATOS, not JCP.

It is the DWP who instigate the ESA WCA migration process, by sending your file (refering you) to ATOS.

ATOS then carry out the "medical" side of the assessment, and return your file to the DWP Decision Maker, with their recommendations.

It is then the DWP DM who actually makes the decision on whether you are entitled to ESA in either group.

It sounds like there has been a "cock up".
