Just to clarify here, to be exempt from WFI's or WRA, your husband must be the person "Giving" care to someone else, not receiving care.

Hi bro

If you look at my original post first paragraph it tells you may situation. I wanted to know if he gets paid the carers premium that should exclude him from the WFI'S or have i got it wrong. I get the carers allowance i understand that but we were just asking who gets paid the carers premuim?

Yes I understand that. :) However, if your husband receives the "Carer Premium" for you, as his carer, he will not be exempt.

To clarify once more, to be exempt, he must be "Giving" the care to someone else, not receiving the care.

Otherwise, recipients of Higher or Middle Rate Care Component of DLA would be exempt, which is not the case.

Bro I have re-checked the relevant ESA Regulations and I cannot see anything that requires the person receiving the Carers Premium to be the person giving the care, or that this does not entitle them to be excluded from WFIs.

If that is the case Gordon, I stand corrected. :)

I was working on the premise that it is quite possible for one member of a couple to receive " Carer Premium" for their partner in the form of an IR ESA top up, as the recipient of the "top up" is in receipt of Middle or Higher rate care of DLA, and their partner gives care to them.

In the situation that you put forward would that then mean that the giver of the care, and the recipient of the care are exempt ?

That's on the premise of course that both members of the couple may otherwise be compelled to attend WFI's WRA, for whatever reason.
