transfering from IB to ESA wrag appeal timetable

hi, in october 2011 i was transferred from IB to wrag without a medical examination. i have since written to the DM on 3 occasions and also telephoned them to have the decision changed to the support group. i have had no response in this time and am worried that the time for an official appeal has passed. what will happen in oct.(i sent a completed appeal form to them in sept 2012) when my years wrag has expired? can i still appeal as i have had no contact from the DM regarding this?
i will be very grateful for any info. received

Hi b,

You are supposed to submit a request for an appeal or a reconsideration, within one month of the date of the adverse decision.

A late appeal can be made upto 13 months after an adverse decision if you can show good cause.

Even if you have simply written a letter as you stated, this should also be considered as a request for a reconsideration, at least, as long as it was within the one month deadline.

To pick up on your other point, bendit, your contributary ESA will still end after 365 days even though you are awaiting appeal. You will only get more money if you qualify for income-related ESA or if, eventually, you are put into the Support Group.
