Hi all
Firstly apologies if I should have used an old thread.
I am really feeling happy but also confused. As you ma yknow from recent thread I have an appeal waiting to be heard from decision to put me in WRAG in June 2011, and was also sent a new ESA50 in July 12 to be reassessed.
My payments for the WRAG decision stopped in Aug 12 due to 365 day rule. I sent in the new reaassessment on July 18th 12 and have today received a letter telling me that I have been moved from WRAG to Support group with effect from 9th Oct 12, and that the first payment has been made to my bank. Ther was no mention of any back pay, so I called JCP who have just phoned back to say that the back pay decision is with a DM checking my NI contributions, does this sound right.
I would also like to thank all memebers, and especially all the Mods for their great advice and support,I also had help from Good advice matters welfare officer. Without the help of everyone I don't know how I would have coped.
It is great that there are people like the Mods who give up their time to help.
I have now requested the ESA72 and ESA85a to find out the medical report and length of the award.

Congratulations on being moved to the Support Group.

My understanding, and I am happy to be proved wrong, is that ESA Decisions apply from the date of notification, and as such you should not expect to receive any back payments.

Maybe it is me that is wrong I just presumed that as the JCP sent me the form back in July and that it had to be returned by the 23rd July any payments would have to be backdated otherwis e they could take as long as they want to make a decision

Happy to be proved wrong.

It may be that the DWP are operating differently for those who have been time limited, however, if we take this out of the equation, you normally would have received the WRAG rate until the The Decision was issued and then the Support Group rate with no back payments.

HI as i am new to the forum .I have CFS M>E and recently been dianosed with osteo arthiritis in my knees ,I applied for DLA but was refused followed your guide lines to request at the claim to be looked at again ,i now have received a letter from atos bout a doctor visiting my home .how long do you wait till they arrange a visit as i havent heard yet ,and what do i have to expect when they arrive thanks x

Hello chelle,

ATOS have to give 7 days notice for ESA assessments, I assume that the same aplies for DLa medicals. As for what to expect, this might help you
