Confused what to do next was created by Rich
I regard myself as being someone who is of average intelligence but I am confused about what is taking place because the paper work that came though is certainly confusing, in my opinion deliberately making it difficult for people to understand. Thank goodness my wife is a medical professional who can read through the bilge but even she is confused exactly what they are saying in the letter.
I attended an ATOS assessment and within two weeks was told that I was going onto the work related part of the new system. I am going to appeal as I think I should go on the support group but as I am going on holiday soon for two weeks I have little time in gathering all the evidence from doctors. I spoke to the DWP and Benefits Office and they say that it does not matter if I do not have all the medical evidence, only that I appeal the decision as soon as possible within the month. However on all the advice lines it says I should provide as much medical evidence as possible.
When I send my GL24 for my appeal will it matter if I do not send medical notes in, a GP support letter at the time, by adding a note that these will follow?
As for getting through the electronic walls of the DWP or job centre plus to speak to a human its almost impossible, like finding a live person in the barren lands of the Tundra and what makes even more it so galling is that it is a costly telephone number with awful music to fill in the long delay to speak to anyone.

There are two aspects to making an appeal; lodging the appeal with the DWP and then submitting evidence to support your case.

So you need to lodge the appeal within one month of the date on the Decision letter, you only need to provide a brief explanation of why you are appealing. See

How long do I have to appeal?

How to submit an appeal

One you have sent of your GL24 you can then think about providing a submission and evidence.

You can either try to overturn the Decision during the Reconsideration stage, in which case you have about four weeks from submitting the GL24 to provide the Decision Maker with any additional evidence, the period may be longer due to delays in the system, but the extra time cannot guaranteed.

If you are unable to get all of your additional evidence available for the Reconsideration, then you can make it available for the appeal hearing. Tribunal rules require you to submit any further evidence within one month of your receiving the evidence packet from the DWP, however, in practice they will accept information upto 2-3 weeks before the hearing.

If you have not already done so, have a look at our ESA Appeal guide on the following link.
