IB to cWRAG...but should have been Support. Help!

Hi,
New to the forum but not to B&W (thank you for your help over the years).
I was sent my ESA50 in May, replied on time in June, including supportive letter from GP who knows me well.
I have a variety of interlinked progressive neurological conditions causing severe pain, v v limited mobility, faints, falls etc etc etc
I had hoped that with B&W help -and law on my side - I should get migrated straigh to Support group since I am unable to mobilise 50m without severe pain...walk v v short distances, well less than 50m, in excruciating pain using stick, can't propel manual wheelchair cos my right arm is affected aswell as my legs. GP's letter confirmed this and basically quoted the grounds for making support group cos being unable to mobilise.

Was NOT invited for 'medical', received decision (into cWRAG) a couple of weeks back. CAB and local welfare rights can't see me for months :(
Seeing GP this Thursday, have to have filed for appeal by 17th of the month....

To me, it seems clear, I simply can't mobilise that far (and have other possible support group descriptors applying to me too, ie altered consciousness more than weekly cos of fainting etc), so assume this is just a DWP game...

I will appeal. Have used B&W template letters, GL24, and requested in writing Subject Access Request. What more do I need to do at this stage? GP will support me, but doesn't have a lot of time to write something additional in my 'defence'.

My hubby is bipolar, works part time and is my full time carer, last year he earnt just over £7600....so cWRAG (ie ESA payment stopping after a year) could not be more devastating for us.
Help, advice, support gladly received.

Hi fd,

An all too common occurance, I'm afraid.

You should request the ESA85A medical report, and any other information used in coming to the WRAG decision, see :

ESA medical – what forms to ask for?

Many members have had successful reconsiderations, on appealing, by reiterating how they feel that they should have qualified for the SG, see :

Qualifying for the Support Group

Do not miss your 1 month deadline to appeal, if the ESA85A, etc has not arrived, you can request this over the phone, (back up in writing)

The automatic reconsideration will be carried out by a different more senior DM, so there is a chance that the decision may be changed to SG.

Hi again,

Got a letter yesterday to say that following 'new information' my ESA has been 'reconsidered'.
Nowhere in the bulk of the letter did it say 'Support Group' but on the last page there's a breakdown of 'how your money is calculated' which included an extra bit for 'Support Group'.

So, the assumption is they have reconsidered in my favour, phew, and I won't need to go to tribunal / have a few months peace and quiet I hope!

Is is still worth me trying to get hold of the ESA85A? I'd quite like the heads up on when they intend to send out the next ESA50 and we can begin the whole merrygoround again.

Thank B&W for all your advice, we got there in the end (I think!)...now to do battle against PIP and keep the Motability car....

If it states that you will receive "The Support Group Component", then it would appear that you have been successful.

An early Xmas present. :)

You may still wish to request the ESA85A to find out the prognosis, (expected length of The SG award before reassessment) However, as The DWP DM, has overidden the ESA85A recommendations at the reconsideration stage then the information in the ESA85A may no longer be pertinent.

The LT54 may contain more information, further you could phone up, (written back up advisable) and stipulate that you would like written confirmation of the prognosis, and on which SG descriptors you qualified for The SG.
