Thank you, I have already started the appeal and I have recieved the confirmation letter. I am on ESA CB, so I only can recieve it for a year and I cannot claim ESA IB as my partner works full time. I did telephone DWP yesterday after my posting and the man said he was getting someone to call me today, before two ! But nothing, so how would you advise me to get in touch with Data Commisioner, as I dont know what they do or how I should contact them.

Contact detals of the Information Commissioner (sorry, I wrongly referred to 'Data Commissioner') are on the thread I linked to in my first answer :)

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Thanks for that I have found it. Also when you appeal to be put in to the support group from the WRAG, how long does it take for a new desicion maker to look at it again and let you know that the first desicion cannot be changed, is it before your papers get sent to the tribunal.

Hi n,

I'm afraid this is another "How long is a piece of string" questions. :(

We have heard from members where they have heard in a matter of days, whilst others have been waiting months.

They used to give a guideline of a max of around 11 weeks for a reconsideration, here I would like to emphasise "used to", this was before the DWP became "Gridlocked".

We are in the same boat - sent off data request 45 days ago but heard nothing yet and wondering whether to start chasing it.
We also appealed 6 weeks ago, but haven't had a confirmation letter. Didn't realise that was the norm. Beginning to worry now that all our paperwork has disappeared into a black hole (or to be more precise got lost between Edinburgh and carlisle as we were told the case was being transferred, ironically in order to "fast track" it).
Look forward to hearing on this thread how to complain to Data Commisioner
