IB TO ESA WRAG NO MEDICAL. was created by fithgear
After waiting months moving from IB to ESA I have received a decision I have been awarded esa WRAG contribution-based. Without a medical.
I was told over the phone this was for two year but nothing on the decision I received tells me the award length or anything else really.
I am thinking about appealing due to chronic arthritis, copd 3rd stage, peripheral neuropathy, Lost feeling in my feet, And Diabetic foot ulcers. I sent 4 consultants letters and my GPs supporting letter stating I could not mobilise for more than 15 metres.
It looks as though they have used the invisible manual wheel chair to deny me support group. I am not physically able to self-propel a manual wheel chair Independently and safely.. I do not know what points I have been awarded or in which group the points were awarded for. I intend to ask for all documents using SAR.
My questions are,
1. what documents do I ask for considering I did not have a medical as I would like as much info as possible to make an informed decision on appeal.
I was under the impression that ATOS OR DWP would contact my GP with the ESA113.
2. But my GP has informed me that they have not sent him an ESA113 OR anything else. Is this normal.
3. If I do appeal Is there a risk I could lose my award even though I have not had a medical.
4. Also as I have been on Incapacity Benefit for ten years now why have they put me into the contribution based benefit. I was lead to believe you had to have worked recently to qualify for contribution based ESA.
5. As I have been awarded WRAG for two year what happens after the first year and my 365 days are up, do I have to reapply?
Sorry for all the questions but I am totally confused

Hello fg,

Firstly, congratulations on being awarded ESA. Many people view this as a 'falure' but DWP have accepteed tat you are not fit fo work, so that is a big step.

1) There will be an ESA85a as you did not have a medical, this will give you an idea of what descriptors you scored on and when to expect reassessment. The contents of this FAQ still apply
ESA medical – what forms to ask for?

2) DWP are not obliged to contact your GP and they often don't.

3) Yes, there is always a risk that you could lose ESA if you appeal. The ESA85a will give you an idea of whether your clam is secure
Is there any risk in challenging the decision?

4) All IB claimants are being transfered onto Contributary ESA.

5) Unlike DLA, ESA is an indefinite award that can be reassessed at any stage (which is why there is no reassessment date on the award letter), the 2 years that you have been told is just a guideline. After 365 days in WRAG, you will be assesed for income related ESA. If you are not entitled to tat, you will coninue to get NI credits fr as long as you are judged to remain unfit for work (you would be reassessed at intervals) but would not get any more money.
12 Month Limit for ESA (CB)

You will still be obliged to undertake Work Focussed Interviews even if you appeal. It is sometimes possible to have this carried out on the phone or in your home, but this is entirely at the discretion of your advisor.

You will have 1 month to submit your appeal. I suggest that you get fully acquainted with our ESA and appeals guides and FAQs and ask any further questions on this thread.

Thank you for your reply Mrs Hurtyback but still not sure apart from the ESA85A what evidence I can ask for have looked at the FAQ but that applys for people who have had a medical.

As you did not have a medical there will be an ESA85a for you. The rest of the FAQ applies whether or not you had a medical.

Hi fg,

You are still classed as having a "medical" albeit under "paper scrutiny" a paper assessment.

There may also be an LT54 form, there is a full list of potential ESA forms in this FAQ :

Recently, we have heard of the : ESA72 Form being used, from some members.
