ESA Tribunal on Friday

Thank you.

I did in fact send in 3 medical letters to the DWP initially with my appeal.

They mislaid the first appeal dispite me taking it directly into the jobcentre myself.

I then had to fax it through to them again 3 weeks later. When they did the reconsideration they had misplaced the medical evidence. It was only when I phoned up and queried it they found one of them but said they could not find the other 2.

She told me that as she had already submitted the reconsideration and upheld the original decision it was easier just to send the paperwork directly to the tribunal. she told me that she felt her decision was correct based on the information she had in front of her at the time the decision was made

Hi Js,

This is exactly what will be said, that the DM can only make a decision on the evidence in front of him at the time.

Hopefully, when the Tribunal are made aware of it, they will find in your favour. :)

I would like to say a very big thank you for the information and help on this site.

I WON :laugh:

6 points to WRAG - I think they already had their decision before I went in there, as they did not ask me any questions about my condition

Hi J,

That is good news, :cheer:

Thanks for letting us know. The Tribunal must have awarded you at least a further 9 points to the 6 that you were originally awarded to give you the minimum WRAG qualifying criteria of 15 points.

I don't wish to put a dampener on things, but as you are aware the Tribunal award of WRAG will now be backdated to the time of the fit for work decision(01/03/12). Therefore you will now be classed as having been in the WRAG since that date, and should therefore receive backpayment of The WRA Component from then.

However, if your ESA is Contribution Based, you should be aware of this : 12 Month Limit for ESA(CB)

Hi

Thank you yes I was aware of that. For me, to be honest it was more about the prinicpal of it rather than the money although that will help out nicely.

Once again thank you if it had not been for this site helping I would have been in a real mess

I am glad that you were aware of that, and I haven't ruined your triumph. :)

We all know what used to happen to the "Bearer of bad news" :laugh:

You have your backpayment of the WRA component to look forward to now. It may help to speed this up if you send copy of the written decision to the DWP when you receive it. (if you haven't already got it)

Just to remind you that if your condition deteriorates to the extent that you feel that you may qualify for the SG, you can request a supersession (Review). See :
