ESA Granted but want JSA was created by Jeanne Marshall
My case is different to most. I’ve appealed the decision made July 2011 to give me ESA. I am arguing I should be on JSA because I can work 16 hours a week. The DWP has ruled I should not receive JSA but ESA instead. This isn’t because I’m ill, as stated I can work 16 hours a week; I’ve been refused JSA because of the terms and conditions I’ve negotiated for myself. I’ve negotiated (1) I sign on once (which I did in July 2011) and that’s it I don’t sign anything again until my circumstances change; no more public humiliation signing on every two weeks and (2) I don’t go looking for work; work comes looking for me. You’ll never believe the fight I’ve had to get JSA. Has anyone else experienced this discrimination? Consequently, DWP is still paying me DLA, Income Support and Incapacity Benefit. The DWP will have kittens if it’s inundated with claims for JSA on the above conditions. Be brave! Do it! Don’t sign the JSA forms when you attend interview. If you are not in the Support Group claim JSA on these terms and appeal when they refuse it. I’ve also appealed decision not to give me JSA; case currently lodged with Upper Tribunal in London.

I'm afraid I can't see how you can make an appeal against an ESA decision not to grant you JSA, however as we do not advise on JSA or appeals to the Upper Tribunal, there is nothing really we can advise you on.

I've appealed the decision to give me ESA and I've appealed the decision not to give me JSA. I haven't appealed an ESA decision not to give me JSA. That can't happen.

It's OK to publicly use my name. People do. Thanks for concern anyway.

I really don't think I can elaborate beyond my original post.

We do not advise on JSA.

We cannot assist with an appeal to the Upper Tribunal.

With regard your ESA appeal, other than to suggest you close your ESA claim, which I assume is stating the obvious, I cannot see how we can assist with an appeal not to claim the benefit.
