Permitted Work

I have been doing 3 hrs work a week and receiving under £20.00 for a few years, I have notified the DWP.

I recently had my Face to Face Assessment and am awaiting the outcome.

If they fail me and say fit for work I will be appealing, my question is can I continue to do my 3 hrs whilst the appeal is in progress?

And our FAQ : Permitted Work

It is not a straightforward issue that we can give a definitive response on. Mainly due to the fact that only the DWP can decide that any work that you may undertake is classed as "Permitted Work", or not.

We do warn that if you are carrying out any "Permitted Work" that the assessing ATOS HCP will be aware of this, and may make assumptions from this, with respect to your limited capability for work, and/or work related activity.

Surely if I am appealing a decision has not been made and certified, therefore I would of thought ESA rules apply, these are my thoughts on this.

Please take into account that if you have previously been in receipt of IB, SDA or IS on grounds of incapacity for the past 8 years there where different qualifying criteria, in that to qualify for IB, you had to pass The (PCA)Personal Capability Assessment, or you may have been PCA exempt.

With ESA the qualifying criteria are far more stringent, you have to pass a Works Capability Assessment (WCA).

Therefore, all I am saying is, the fact that you carry out "Permitted Work", which you may well have authorisation to do, will be taken into account in your ESA WCA.
