My hubby had his ESA medical at the end of September, strangely enough it was held 17 miles away at 10.15 on a Sunday morning,
he was given instructions on how to get there, with bus & train timetables and info on how long the walk would be and how long it would take.

Quite odd really for someone whose main problem is walking!

Anyway, he received a phone call today from a DWP person who told him he didnt qualify for ESA, after some discussion and him saying he didnt agree with the decision, he 'thinks' he was told that he would be getting ESA, that his amount of benefit wouldnt change but that he would have to have another medical.

Hes not the best at asking the right questions so hence the lack of important information.

Does this seem to be right? Has anyone else had this kind of response.

Hi Rr,

There seems to be some confusion here, as there are three possible outcomes as a result of a face to face assessment.

1. Failed to gain at least 15 points, "fit for work" ESA payments (or IB/SDA/IS if you were migrated over to ESA) cease, as from a prescribed date.

2. Awarded 15 points or more cumulatively, therefore placed in the Work Related Activity Group, (WRAG) of ESA.(or qualified for the same under exceptional circumstances rules)

3. Qualified for ESA in The Support Group, (SG) beacuse you fulfilled at least one of the SG Descriptors.(or qualified for the same under exceptional circumstances rules)

You should receive written notice of this decision, and need to clarify whether or not hubby has been awarded ESA in either group, or not.

Once you are aware of the decision, you can then decide whether you wish to appeal or not.

These two phrases contradict each other :

"he received a phone call today from a DWP person who told him he didnt qualify for ESA,"

" he thinks' he was told that he would be getting ESA,"

After the conversation when he was told he didnt qualify, he was discussing the reasons why and explaining from his point of view.
When the conversation was over he said he had just been told that he would be receiving ESA and that the person he was speaking to had changed her mind based on the information and answers to questions he had been asked.
He really wouldnt think to ask which group or anything else, Im the one who worries about all that!!

I did want to know if it was common to be asked to attend for another medical?

Hi Rr,

This is a feasible scenario, as sometimes when a DWP Decision Maker is thinking about making a "fit for work" decision, he will phone the claimant to see whether they can offer any further reasons why they should not be classed as fit for work.

If this is the case, and your hubby has pusuaded the DM that he should be awarded ESA in either group, you still need something in writing (which you are legally entitled to) to confirm the ESA Award.

When a claimant is awarded ESA in either group, there will be a recommendation of how long the award lasts before they are re-assessed, this is when they would receive another ESA50, and may have to attend a further "Medical".

Firstly, you need confirmation of the ESA award before you can think further ahead.
