Hi bro, do you think it is wise for me to try and take this any further with ATOS , as I really do feel that a registered nurse is NOT trained to deal with a mental health case ,surley.

I really can't advise whether or not you should make a complaint to ATOS regarding the Nurse who did your assessment.

Hi, if a new DM looks at my case and cannot change the decision (ESA WRAG to the ESA support group). When it comes to the appeal does the DM have to include a submission into the appeal papers which I will recieve ?
If so, if they go into detail about the points I scored for which activity,what can I do if I requested the information they held on me under the data protection act 1998 regarding the desicion made and I recieved documents, but nothing mentioning what points I scored.
E.G If they submit a submission with details of my points allocation, but they have not sent me any documents regarding what points that I scored and for which activities,surely they have broken some kind of law by using info that they have not sent me when I asked for it under the act.

Hi Noel,

DWP are obliged to send all of the paperwork associated with your claim to the Tribunals service, and you will receive an identical 'bundle' of papers.

Thanks, but what if they include documents or evidence that I origionally asked for under the data act 1998 and did not recieve or see them ?

Also , how can you decide wether your award for WRAG is safe by looking at your EASA85A if it does not help you by saying what points you scored and for which activities. (when appealing)
