Getting an ESA85 was created by Derekq
Hello Forum
Probably like asking how long is a piece of string, please can anyone let me know if they requested an ESA85 from the dwp and how long it took to arrive.
Also if they had to constantly chase the dwp up in order to get the ESA85.
Have read that it can be requested verbally but should be followed up by a written request is this corrct ?

In al honesty I can't see why this should take more than a couple of weeks at most.

We recommend following up in writing because the competency of the call centre staff, who usually take these requests can be quite variable.

Anyone who has waited more than four weeks would be advised to submit a Subject Access Request for the information.

I notice you seem to distinguish between merely writing in addition to telephoning asking for the form, and making a subject access request. I recently called up asking for the ESA85A and also sent off a subject access request further to that. Was I wrong to do this? Am I now likely to get two sets of the same information? Or will this make the process take longer by having asked for a SAR?

I rang to ask for my ESA85A (IB to wrag no medical)on the friday morning and it arrived on the saturday morning!
Is this some sort of record :lol:

Hi k,

Requesting the documents over the phone is not classed as a formal request, therefore it could be ignored, mistakenly or otherwise.

Whether you use a SAR Form, or simply put your request in writing, they should both be classed as formal requests for personal information under The Data Protection Act 1998. The DWP have Data Control Officers who specifically deal with these requests, and are supposed to provide it within 40 days.

I would not worry, as even if you receive the same information twice, better to have too much than not enough.
